Insurer Seeks Exit From Suit Over Bratz Case Coverage

Law360, New York (November 24, 2009) -- Evanston Insurance Co. has moved for summary judgment in MGA Entertainment Inc.'s suit accusing several insurers of breaching their duty to defend against a trade secrets action filed by Mattel Inc. over the popular Bratz dolls, saying it is not responsible for $50 million in past defense costs or defense costs incurred before MGA tendered its defense to Evanston.

Evanston and its parent company, Markel Corp., filed the motion for partial summary judgment Monday in the U.S. District Court for the Central District of California....
